Gershwin's Taxi Horns Terms of Use
These Terms of Use govern your use of the Gershwin’s Taxi Horns app, made by Byteshire LLC (“we,” “us”). By downloading or using Gershwin’s Taxi Horns, you agree to these terms.
License
Gershwin’s Taxi Horns is licensed, not sold, to you for use only under these terms and under Apple’s Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these terms and Apple’s Standard EULA differ, these terms govern the matters they address; Apple’s Standard EULA governs everything else.
Your use of the app
Gershwin’s Taxi Horns is an instrument: it plays a honk when you tap a horn. It sounds even when your device’s mute switch is on, as instrument apps do, so you are responsible for where and how loudly you play it. The app keeps nothing but your tuning and sound choices, on your device, as described in our Privacy Policy.
The app contains no recording of any orchestra or performance. Its two tunings are our reading of the pitches used for the taxi horns in An American in Paris; they are offered for play and study, not as a reference for tuning a real instrument.
Acceptable use
You agree to use Gershwin’s Taxi Horns only for lawful purposes and not to attempt to interfere with, reverse-engineer, or disrupt the app except to the extent that the law permits.
Disclaimers
Gershwin’s Taxi Horns is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent that the law allows. We do not warrant that the app will be uninterrupted or error-free, or that any honk will match the pitch, timbre, or volume of a real taxi horn or of any particular performance.
Limitation of liability
To the fullest extent that the law permits, Byteshire LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Gershwin’s Taxi Horns.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date above and post the new version at this address.
Governing law
These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules.
